Welcome to MyBidspace (“MyBidspace,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the MyBidspace website, features, and services (the “Platform”).

By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Definitions

  • Project Owner: A user who posts a project or requests bids.

  • Contractor: A user who views projects and submits bids or proposals.

  • User: Any person or entity using the Platform.

  • Content: Any text, files, images, project details, bids, messages, or other information submitted to the Platform.

2. What MyBidspace Provides

MyBidspace is a marketplace platform that helps Project Owners connect with Contractors. We do not provide contracting, construction, repair, engineering, design, or similar professional services, and we are not a party to any agreement between Project Owners and Contractors.

3. Eligibility and Accounts

You must be at least 18 years old to use the Platform. You agree that any information you provide is accurate and that you will keep your account information up to date.

You are responsible for all activity that occurs under your account.

4. User Responsibilities

When using the Platform, you agree to:

  • Provide accurate project details and bid information

  • Comply with all applicable laws, codes, permits, and licensing requirements

  • Communicate respectfully and professionally

  • Not misuse the Platform for spam, fraud, or deceptive practices

Project Owners and Contractors are solely responsible for:

  • Project scope, timelines, pricing, and deliverables

  • Permits, inspections, licenses, insurance, and code compliance

  • Background checks, references, and due diligence

  • Any contracts they enter into with each other

5. Bids, Quotes, and Agreements

All bids/quotes submitted through MyBidspace are provided by Contractors and are not verified by MyBidspace. Project Owners and Contractors may negotiate terms directly.

Any agreement, contract, payment schedule, change order, and dispute is strictly between the Project Owner and Contractor.

6. Payments (If Applicable)

If the Platform allows payments or fees (now or in the future), additional payment terms may apply and will be disclosed at the time of payment.

MyBidspace is not responsible for:

  • Payment disputes

  • Chargebacks

  • Contractor performance or completion

  • Refunds between Users

7. Prohibited Uses

You may not:

  • Use the Platform for illegal, harmful, or fraudulent purposes

  • Misrepresent your identity, credentials, licensing, or insurance

  • Post false project details, fake bids, or misleading pricing

  • Attempt to access other users’ accounts or data

  • Upload malware, harmful code, or attempt to disrupt the Platform

  • Scrape, copy, or harvest data from the Platform without permission

We may suspend or terminate accounts for violations.

8. Content You Submit

You retain ownership of the Content you submit, but you grant MyBidspace a non-exclusive, worldwide, royalty-free license to use, display, and process that Content to operate and improve the Platform.

You represent that you have the rights to post your Content and that it does not violate any laws or third-party rights.

9. Intellectual Property

The Platform, including branding, design, and software, is owned by MyBidspace or its licensors and is protected by applicable laws. You may not copy, modify, or distribute our materials without written permission.

10. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We are not responsible for third-party content, policies, or practices.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available.” We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

MyBidspace makes no warranties regarding:

  • Project outcomes

  • Contractor qualifications

  • Bid accuracy

  • Safety, quality, or legality of work performed

12. Limitation of Liability

To the maximum extent permitted by law, MyBidspace will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or project delays.

Our total liability for any claim related to the Platform will not exceed the amount you paid to MyBidspace (if any) in the twelve (12) months prior to the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless MyBidspace from claims, damages, liabilities, and expenses arising out of:

  • Your use of the Platform

  • Your Content

  • Your interactions or agreements with other Users

  • Your violation of these Terms or any law

14. Termination

We may suspend or terminate access to the Platform at any time if we believe you violated these Terms or used the Platform in a harmful way.

You may stop using the Platform at any time.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of Illinois, without regard to conflict of laws principles.
